Terms of service
Last updated: October 19, 2026
1. Scope
1.1 These Terms and Conditions ("Terms") apply to the use of our online platform https://plakos.co.uk/ (the "Platform") and to all contracts concluded through it between Plakos GmbH, Willy-Brandt-Allee 31, 23554 Lübeck, Germany ("we", "us", "our" or "Plakos") and you as our customer ("you").
1.2 Our offers are directed at both consumers and business customers. A "consumer" is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession. A "business customer" is anyone acting for purposes relating to their trade, business, craft or profession. Provisions that apply only to business customers are expressly marked as such.
2. Our Products and Services
2.1 Through the Platform, we offer digital products, in particular online test trainers and learning apps for preparing for tests, selection procedures and job applications, as well as subscriptions to such products. The details of each product are set out on the relevant product page.
2.2 We sell all products and services in our own name and for our own account. Some products are provided by our partners (whose logo appears during the order process), who act as our subcontractors. Your contract is always with us. Where a partner applies additional product-specific terms of use, we will draw your attention to them clearly before you place your order and give you the opportunity to read them.
2.3 The Plakos Akademie learning app and our other learning products are independent offerings developed and operated by Plakos GmbH. They are not affiliated with any government authority, public body or official organisation. All content, exercises and features are intended solely to help you prepare for tests, selection procedures and applications. We cannot guarantee that you will pass any particular test or selection procedure.
2.4 For business customers only: Any terms and conditions of the business customer shall not form part of the contract, even if we do not expressly object to them.
3. How the Contract Is Formed
3.1 The presentation of products on the Platform does not constitute a binding offer by us.
3.2 To place an order, add the product(s) to your basket, enter your details and select a payment method. By clicking the "Buy now" button, you submit a binding offer to purchase the products in your basket. You can review and correct your details before submitting your order. You must accept these Terms in order to place an order.
3.3 After you have placed your order, you will receive an email confirming that we have received it. This confirmation does not yet constitute acceptance of your offer. The contract is concluded when we send you the email containing your login details or otherwise expressly accept your order. We may decline an order; in that case, we will inform you and refund any payment you have made without delay.
3.4 We store the text of the contract. You can print it at the final step of the order process, and we will also send you your order details by email. Information on how we process your personal data can be found in our Privacy Policy.
3.5 The contract language is English.
4. Software
4.1 Where a product consists of or contains software, the software is supplied in accordance with the applicable licence terms. You may only copy, adapt, translate, make available, distribute, modify, disassemble, decompile or combine the software with other software to the extent expressly permitted by the licence terms or by law, in particular the Copyright, Designs and Patents Act 1988.
4.2 For business customers only: You shall indemnify us against all liability, claims and costs arising from any infringement of third-party rights by you.
5. Prices
5.1 The prices applicable at the time of your order apply. Prices are shown in the currency displayed at checkout and include VAT.
5.2 As our products are delivered digitally, no delivery charges apply.
5.3 The total amount is due for payment immediately upon conclusion of the contract.
6. Payment
6.1 We offer the payment methods displayed during checkout.
6.2 If you purchase a subscription product or a product payable in instalments, you authorise us to collect the recurring payments or instalments using the payment method you have selected. The amount of each payment and the payment intervals are clearly shown on the order form before you place your order.
6.3 If you choose to pay by bank transfer, please use the following bank details:
Account holder: Plakos GmbH
IBAN: DE58 2304 0022 0017 3401 00
BIC/SWIFT: COBADEFFXXX
Bank: Commerzbank
Payment reference: your invoice number
7. Right to Cancel
If you are a consumer, you have a statutory right to cancel your contract. Full details, including the model cancellation form, can be found in our Cancellation Policy.
8. Delivery
Our products are purely digital. We will send you your login details by email. This is usually done immediately and at the latest within 20–30 minutes of the conclusion of the contract.
9. Your Statutory Rights
9.1 We are under a legal duty to supply products that are in conformity with the contract. If you are a consumer, you have statutory rights under the Consumer Rights Act 2015: digital content must be of satisfactory quality, fit for purpose and as described. If it is faulty, you are entitled to a repair or a replacement and, in certain cases, to a price reduction. If faulty digital content supplied by us damages a device or other digital content belonging to you, you may be entitled to a repair or compensation. Nothing in these Terms affects your statutory rights.
9.2 Please report any faults to support@plakos.de.
10. Availability of the Platform and Our Liability
10.1 We always endeavour to ensure that the Platform is available without interruption and that transmissions are error-free. However, this cannot be guaranteed at all times. Access to the Platform may occasionally be interrupted or restricted to allow for repairs, maintenance or the introduction of new features. We endeavour to keep the frequency and duration of such interruptions to a minimum.
10.2 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for any other liability that cannot be limited or excluded by law.
10.3 We are liable without limitation for loss or damage caused by our deliberate breach or gross negligence.
10.4 Otherwise, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or of our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.
10.5 These limitations of liability also apply in favour of our employees, agents and subcontractors.
11. AI-Powered Learning Features and Fair Use
11.1 We may provide features on the Platform that are based on artificial intelligence (e.g. AI-powered interview simulations, automated test evaluations or personalised learning paths) ("AI Features"). AI Features are an additional voluntary service, do not form part of the guaranteed scope of services and may be adapted or discontinued by us at any time. This does not affect the content and features included in the product you have purchased.
11.2 AI models work on a probabilistic basis and may, in exceptional cases, generate imprecise or incorrect responses. Although we optimise our AI specifically for aptitude tests and examinations, we accept no liability for the accuracy of AI-generated content. You remain responsible for your final preparation for any test or examination.
11.3 To provide a stable system for all users, we reserve the right to temporarily limit your use of AI Features if your individual usage significantly exceeds the average usage within your plan (e.g. by more than 200%). Any such limitation does not affect your access to the regular course content.
12. Complaints and Dispute Resolution
If you have a complaint, please contact us at support@plakos.de and we will do our best to resolve it. We are neither obliged nor willing to participate in alternative dispute resolution proceedings before a consumer arbitration body.
13. Governing Law, Jurisdiction and Final Provisions
13.1 These Terms and any contract concluded under them are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you are habitually resident.
13.2 If you are a consumer resident in the United Kingdom, you may bring legal proceedings in respect of these Terms in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.
13.3 For business customers only: The place of performance for all obligations arising from the contractual relationship is Lübeck, Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with the contract is Lübeck, Germany. You may only set off claims or exercise a right of retention if your counterclaim is undisputed, has been finally established by a court or is closely connected with the claim concerned.
13.4 If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions shall remain unaffected.
13.5 You may not transfer your rights or obligations under the contract to another person without our consent.
